Data protection declaration for the use of personal data in the application process at Skyborn[1]

We are very pleased that you are interested in working for Skyborn and that you are applying to us. We take the protection of your personal data during processing in accordance with the statutory data protection regulations very seriously. Personal data will only be processed in the context of the application process to the extent necessary as the circumstances make this necessary in the individual case. The following information gives you an overview of how we ensure this protection and what kind of data is collected for what purpose.

III. Terms and definitions
The terms and definitions are based on GDPR, BDSG and other data protection regulations. In particular, the definitions of Art. 4 and Art. 9 GDPR apply.


IV. Processing of personal data in the application process
1. Description and scope of data processing and data categories
When providing application documents via our online application tool, by email or post, by recruitment consultants or agents or on any other communication channel, personal data and, if applicable, special personal data will be collected for the execution of an application process. As part of the application process, we process your contact and personal data as well as all data that you provide to us in the course of the application process – this concerns, among other things, the following personal data:
  • First name, last name and date of birth
  • Address, email address and telephone number
  • Nationality, gender, age
  • CV and cover letter
  • Certificates, qualifications and references

Salary requirement
  • Start of activity or notice period
In addition, the information you provide may be special personal data pursuant to Art. 9 GDPR, which is subject to special protection. If an employment relationship should be established, we will transfer all personal data that you have provided to us for the application process into the personnel file.
2. Purpose of data processing and legal bases
We process your personal data to decide on the establishment of an employment relationship with you. At the same time, the personal data serve as a basis for the implementation of any established employment relationship (§ 26 para. 1 sentence 1 BDSG, Art. 6 para. 1 lit. b GDPR). In cases where the processing of your personal data goes beyond the purpose of carrying out the application process, it must be legitimized by individual consent. Insofar as you give us consent to the processing of your personal data, the respective consent is the legal basis for the processing mentioned there (§ 26 para. 2 BDSG, Art. 6 para. 1 lit. a GDPR). This applies in particular to your consent to be included in our applicant pool.
You can revoke your consent at any time with effect for the future (see also section V. 7.) As far as the specific purpose allows, we process your personal data anonymously.
3. Recipients of your personal data
Your personal data will only be passed on in compliance with confidentiality and only to the extent permitted by a legal basis. With your application, you provide your personal data to the responsible department and HR within Skyborn. Your application documents can be viewed and reviewed by the persons involved in the recruitment process at Skyborn
4. Storage period and data deletion
Your personal data will be stored for the duration of the application process. In the event of employment, the information provided is taken over as employee data and continues to be stored, processed or used for the duration of the employment relationship.
If an employment is not achieved, your personal data will be stored for six months after completion of the application process in accordance with Art. 6 para. 1 lit. f GDPR and taking into account the provisions of the General Equal Treatment Act. Thereafter, we process your personal data for statistical evaluations only in anonymous form. If you give us your consent, we will store your personal data from the application process for the period specified in the respective declaration of consent.
5. Obligation to provide your personal data
As part of the application process, we need to process certain personal data in order to be able to check the professional and personal suitability of applicants for a specific position and to ensure a fair application process in relation to other candidates. Without the provision of this data, Skyborn will generally not be able to carry out the application process. This does not apply to data that we process from you within the scope of consent.


V. Your rights
You have the right to receive information about your personal stored data free of charge at any time. In addition, you have the right to request a correction or deletion of your data at any time, provided that this does not conflict with legal regulations or retention periods. You can request the restriction of the processing of your data and object to the processing of your data. You also have the right to data portability. Furthermore, you can complain to the competent data protection supervisory authority about the processing of your personal data by us. In detail, you have the following rights:
1. Right of access (Art. 15 GDPR)
You may request confirmation from the controller as to whether personal data concerning you is being processed by us.


2. Right to rectification (Art. 16 GDPR)
You have a right to rectification and / or completion by the controller if the personal data processed concerning you is incorrect or incomplete. The controller must make the correction without delay.
3. Right to erasure (Art. 17 GDPR)
You may require the controller to erase the personal data concerning you without undue delay and the controller is obliged to delete this data without undue delay, unless one of the exceptions regulated in the GDPR applies or other statutory retention obligations require us to retain the data.
4. Right to restriction of processing (Art. 18 GDPR)
Under the conditions regulated in GDPR, you may request the restriction of the processing of personal data concerning you.
5. Right to data portability (Art. 20 GDPR)
You have the right to receive the personal data concerning you, which you have provided to the controller and the processing of which is based on consent or on a contract with you, in a structured, commonly used and machine-readable format.
In exercising this right, you also have the right to have the personal data concerning you transmitted directly from one controller to another, where technically feasible. The freedoms and rights of other persons must not be adversely affected by this.
6. Right to object (Art. 21 GDPR)
You have the right, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you, which is based on Art. 6 para. 1 lit. e or f GDPR; this also applies to profiling based on these provisions.
If the personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising; this also applies to profiling to the extent that it is associated with such direct marketing. In the event of an objection, the personal data concerning you will no longer be processed for these purposes.
7. Right to withdraw consent (Art. 7 para. 3 GDPR)
You have the right to revoke your declaration of consent under data protection law at any time. The revocation of consent does not affect the legality of the processing carried out on the basis of the consent until the revocation. This also applies to the revocation of declarations of consent that were issued to us before GDPR came into force (before 25 May 2018). All personal data stored on the basis of the consent given in each case will be deleted in this case, unless there is another legal basis for further storage according to the law.
VI. Right to lodge a complaint with a supervisory authority
In the event of infringements of data protection regulations, data subjects have the right to lodge a complaint with a data protection supervisory authority, in particular in the member state of their habitual residence, place of work or place of the alleged infringement. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy.
